1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MySchoolExam ("we," "us," or "our") regarding your use of the MySchoolExam website and services (collectively, the "Platform").

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

2. Eligibility

To use MySchoolExam, you must:

• Be at least 13 years of age, or have parental/guardian consent if younger
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Platform under the laws of Nigeria or your jurisdiction
• Provide accurate and complete information when creating an account

If you are under 18, your parent or guardian must review and accept these Terms on your behalf.

3. Description of Service

MySchoolExam provides a free online platform for students preparing for school assessments and major external exams such as WAEC and JAMB. Our services include:

• Access to practice questions from WAEC past papers
• Computer-Based Testing (CBT) simulation environment
• Answer explanations and review guidance
• Progress tracking and performance analytics
• Leaderboard and gamification features
• Study reminders and daily challenges

Important: MySchoolExam is an independent study tool and is not affiliated with, endorsed by, or sponsored by WAEC, JAMB, or any examination authority.

4. Account Registration and Security

4.1 Google OAuth Authentication

To access certain features, you must sign in using Google OAuth. By signing in, you authorize us to access your Google profile information (name, email, profile picture) as described in our Privacy Policy.

4.2 Account Security

You are responsible for:

• Maintaining the security of your Google account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Acceptable Use Policy

5.1 You MAY:

• Use the Platform for personal, non-commercial educational purposes.
• Share your progress and achievements with others.
• Provide feedback and report errors.
• Recommend MySchoolExam to fellow students.

5.2 You MAY NOT:

• Copy, reproduce, or distribute our questions for commercial purposes.
• Use automated scripts, bots, or crawlers to access the Platform.
• Manipulate leaderboard rankings through cheating or fraud.
• Create multiple accounts to game the system.
• Reverse engineer, decompile, or attempt to extract source code.
• Interfere with or disrupt the Platform's functionality.
• Upload viruses, malware, or malicious code.
• Harass, abuse, or harm other users.
• Impersonate another person or entity.
• Use the Platform for any illegal purpose.

6. Intellectual Property Rights

6.1 Our Content

All content on the Platform, including but not limited to questions, explanations, text, graphics, logos, software, and user interface design, is owned by MySchoolExam or licensed to us and is protected by Nigerian and international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal educational purposes only. You may not:

• Sell, rent, lease, or sublicense Platform content
• Republish content on other websites or platforms
• Create derivative works without our written permission

6.3 Past Questions

The past examination questions on our Platform are sourced from publicly available WAEC materials and are used for educational purposes. We do not claim ownership of WAEC's original examination questions.

6.4 User-Generated Content

If you submit content (e.g., comments, feedback, suggestions), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content.

7. Free Service and No Guarantee of Results

7.1 Free Access

MySchoolExam is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future, but the core platform will remain free.

7.2 No Guarantee of Exam Success

While we strive to provide high-quality practice materials, we do not guarantee that using MySchoolExam will result in passing exams or achieving specific grades. Your performance depends on many factors beyond our control, including your study habits, understanding of material, and exam conditions.

7.3 Accuracy of Content

We make every effort to ensure the accuracy of our questions and answers. However, we do not guarantee that all content is error-free. If you find an error, please report it through our contact form.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Service

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or completeness of content

8.2 Limitation of Liability

To the fullest extent permitted by law, MySchoolExam shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Exam failures, poor grades, or academic consequences
• Damages arising from your use or inability to use the Platform
• Unauthorized access to your account or data

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid us in the past 12 months (which is ₦0 for a free service).

8.3 Third-Party Services

We use third-party services (Google OAuth, Supabase, Netlify, Google Analytics). We are not responsible for their performance, availability, or privacy practices.

9. Indemnification

You agree to indemnify, defend, and hold harmless MySchoolExam, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your use or misuse of the Platform
• Any content you submit

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

11. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue the Platform (or any part of it) at any time
• Change features, functionality, or content
• Implement usage limits or restrictions

We will provide reasonable notice of significant changes when possible, but we are not obligated to do so.

12. Changes to Terms

We may update these Terms from time to time. When we make changes:

• We will notify you of significant changes via email or platform notice

• Your right to use the Platform will cease immediately
• Your data may be deleted in accordance with our Privacy Policy
• Provisions that should survive termination (e.g., liability limitations, indemnification) will remain in effect

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria.

14.3 Informal Resolution

Before pursuing legal action, you agree to first contact us at support@myschoolexam.com to attempt to resolve the dispute informally.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySchoolExam regarding the Platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

15.5 No Agency

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and MySchoolExam.
